{"id":7681,"date":"2019-07-04T11:07:35","date_gmt":"2019-07-04T18:07:35","guid":{"rendered":"https:\/\/vinsuprynowicz.com\/?p=7681"},"modified":"2019-07-04T14:25:58","modified_gmt":"2019-07-04T21:25:58","slug":"7681","status":"publish","type":"post","link":"https:\/\/vinsuprynowicz.com\/?p=7681","title":{"rendered":"They hate Trump so much they&#8217;re willing to  . . . give up the personal income tax?"},"content":{"rendered":"<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/images.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/images.jpg?resize=273%2C185&#038;ssl=1\" alt=\"\" width=\"273\" height=\"185\" class=\"alignnone size-full wp-image-7682\" \/><\/a><\/p>\n<p>Allow me to be the first to congratulate the citizens of the state of New York on the fact they are now one court case away from being forever free of their noxious, redistributive, initiative- and wealth-destroying state income tax.<\/p>\n<p>Back in 1919 &#8212; exactly a century ago &#8212; New York state\u2019s politicians announced they faced a \u201crevenue shortfall.\u201d (That\u2019s what greedy politicians always call it when they\u2019ve bought votes by overspending their income, as in \u201cI bought that nice speedboat and trailer, and jewelry for my mistress, and now that it\u2019s time to buy groceries for the family I seem to be facing a \u2018revenue shortfall.\u2019 I wonder how much I can get if I put a tax on kids&#8217; lemonade stands?\u201d) <\/p>\n<p>The end of the First World War in November 1918 meant New York munitions factories faced a steep drop in profits, you see, reducing the revenue the state government had been bringing in with its \u201ccorporate tax.\u201d At the same time, it was clear that alcohol would soon be banned across the country. (A double whammy!)<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/images-2.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/images-2.jpg?resize=300%2C168&#038;ssl=1\" alt=\"\" width=\"300\" height=\"168\" class=\"alignnone size-medium wp-image-7685\" \/><\/a><\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/images-3.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/images-3.jpg?resize=256%2C197&#038;ssl=1\" alt=\"\" width=\"256\" height=\"197\" class=\"alignnone size-full wp-image-7686\" \/><\/a><\/p>\n<p>The latter was particularly problematic.  At the time, state governments relied heavily on liquor excise taxes &#8212; it was estimated New York state and its localities would lose between $25 and $30 million each year!<\/p>\n<p>So the day before the 18th Amendment was ratified in January, the state\u2019s legislative leaders met with city mayors in Albany and made it clear that an income tax was in the works.<\/p>\n<p>\u201cThe only question to be decided is the rate to be fixed and what size incomes should be exempted,\u201d declared Republican Assembly Speaker Thaddeus Sweet of Oswego.<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download.jpg?resize=181%2C278&#038;ssl=1\" alt=\"\" width=\"181\" height=\"278\" class=\"alignnone size-full wp-image-7684\" \/><\/a><\/p>\n<p>\u201cThe state and localities will be deprived before the expiration of the coming year of several millions of dollars of revenue heretofore derived from liquor taxes,\u201d the State Tax Commission wrote in a February report. \u201cWe believe that the time has come to enter upon a more scientific method of raising revenues for State and locality and for the relief of real estate. In this connection, the Commission recommends the enactment of a general personal income tax at a low rate.\u201d<\/p>\n<p>Yeah, \u201ca low rate.\u201d And \u201cjust on millionaires,\u201d of course. How \u201cscientific.\u201d And so began the systematic destruction of the economic system which for 250 years had allowed hard-working New Yorkers to start small businesses, save their profits, grow those businesses, create jobs, build something for their grandchildren.<\/p>\n<p><strong>I Know: We&#8217;ll get him for &#8216;Tax Evasion&#8217;!<\/strong><\/p>\n<p>But it was a day in June, 1931 &#8212; 12 years later &#8212; that the seeds of the self-destruction of the initiative-destroying, tyrannical \u201cpersonal income tax\u201d were planted.<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-1.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-1.jpg?resize=197%2C256&#038;ssl=1\" alt=\"\" width=\"197\" height=\"256\" class=\"alignnone size-full wp-image-7687\" \/><\/a><\/p>\n<p>Law enforcement types were positively apoplectic over their inability to bring Chicago thug Al Capone to justice. They\u2019d actually facilitated his rise by enacting alcohol Prohibition, which worked about as well as every other government \u201cprohibition,\u201d of course. (No one has smoked marijuana or used a non-prescription opiate in this country since 1933, right? And there are no prostitutes anywhere but in Nevada.)<\/p>\n<p>But the nerve of this Capone guy: He used some of his massive profits from offering the residents of Chicago goods and services they wanted but which the government insisted on \u201cbanning\u201d &#8212; booze, prostitutes, money-lending without a state license, the numbers racket &#8212; to pad the salaries of cops, prosecutors, even judges. On the rare occasion when that didn\u2019t work and a Capone associate was actually brought to trial, the jurors might receive a visit at home in the evening from a couple of guys with broken noses and no necks, complimenting the jurors on what lovely children they were raising, and noting the route the kids used when they walked to school each morning. \u201cBe a shame is anything should ever happen to such nice kids, like being hit by a truck or something.\u201d  <\/p>\n<p>So local prosecution of the Capone mob was pointless. But finally, the federal government came up with a strategy &#8212; remove Capone\u2019s case to the federal jurisdiction: Charge him with failing to declare and pay personal income tax on the proceeds from his illicit businesses!<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-2.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-2.jpg?resize=300%2C168&#038;ssl=1\" alt=\"\" width=\"300\" height=\"168\" class=\"alignnone size-medium wp-image-7688\" \/><\/a><\/p>\n<p>Of course, any first-year law student could see the problem with THAT. The Fifth Amendment to the Constitution guarantees Americans that \u201cNo person . . . shall be compelled in any criminal case to be a witness against himself.\u201d The income tax statute cannot compel a citizen to declare what crimes he has committed by declaring income from pimping, bootlegging, et cetera, because that would amount to compelled self-incrimination!<\/p>\n<p>But then the federals got really cute. \u201cNo, no,\u201d they insisted, \u201cdeclaring income from criminal activities isn\u2019t \u201cself-incrimination,\u201d since IRS filings are \u201cCOMPLETELY CONFIDENTIAL!\u201d The IRS would NEVER share information from such filings with any law enforcement entity, or any other government agency at all. It would be perfectly safe to report \u201c$5,000 received for assassinating the governor.\u201d You could declare the income, pay taxes on it, and no one would ever be the wiser. Because income tax filings are SECRET! See?<\/p>\n<p>Frankly, with IRS agents now eagerly participating in the busting of narcotics traffickers in various \u201cmulti-jurisdictional drug task forces\u201d like Michigan\u2019s \u201cDownriver Area Narcotics Organization (DRANO)\u201d I suspect IRS \u201csecrecy\u201d has long been a de facto dead letter.<\/p>\n<p>But for the legislative body that created the tax to openly ADMIT that?<\/p>\n<p><strong>Throwing away the myth of &#8216;confidentiality&#8217; . . . with both hands<\/strong><\/p>\n<p>At <a href=\"https:\/\/www.newsweek.com\/donald-trump-taxes-new-york-law-1433262\">https:\/\/www.newsweek.com\/donald-trump-taxes-new-york-law-1433262<\/a> , Nicole Goodkind of Newsweek reported a month back \u201cNew York Passes Law to Release President Trump&#8217;s State Tax Returns to Congress.&#8221;<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-3.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-3.jpg?resize=277%2C182&#038;ssl=1\" alt=\"\" width=\"277\" height=\"182\" class=\"alignnone size-full wp-image-7689\" \/><\/a><\/p>\n<p>New York state\u2019s Democrat-dominated Assembly \u201cpassed a bill on Wednesday to make six years of President Donald Trump&#8217;s state tax records available to Congress.<\/p>\n<p>\u201cThe TRUST Act, which passed the State Senate earlier this month and now makes its way to Governor Andrew Cuomo&#8217;s desk, would allow the commissioner of the New York Department of Taxation and Finance to release Trump&#8217;s state tax returns to the chair of the federal House Ways and Means Committee, the Senate Finance Committee and the Joint Committee on Taxation for any \u2018specified and legitimate legislative purpose.\u2019\u201d<\/p>\n<p>Which we all know means \u201cfor NO legitimate legislative purpose, at all, but simply to see if their fellow Democrats can \u2018get something\u2019 on Trump to use against him in the 2020 campaign.\u201d<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-4.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-4.jpg?resize=289%2C174&#038;ssl=1\" alt=\"\" width=\"289\" height=\"174\" class=\"alignnone size-full wp-image-7690\" \/><\/a><\/p>\n<p>\u201cDonald Trump and his administration are doing everything they can to conceal the truth about his finances and massive conflicts of interest by illegally blocking Congress from obtaining his tax returns,\u201d lied the progressive advocacy group Stand Up America in a prepared piece of Far-Left propaganda. (Trump has been under virtually continuous IRS audit for years. If he weren\u2019t \u2018clean as a whistle,\u2019 we would presumably have heard about it by now. And it&#8217;s only RELEASING a citizen&#8217;s tax returns that would be &#8220;illegal.&#8221;)<\/p>\n<p>\u201cIn order to circumvent this stonewalling,\u201d the degenerate collectivist scum continue, \u201cNew York lawmakers are providing a new avenue for the House Ways and Means Committee to obtain these crucial financial documents. As soon as this bill becomes law, all Chairman [Richard] Neal will have to do is ask.\u201d<\/p>\n<p>\u201cThe president&#8217;s tax filings in New York state, where his business and campaign are headquartered, will likely reveal similar information to what is in his federal returns,\u201d Newsweek noted. \u201cLast month, Neal requested six years of the president&#8217;s tax returns and other business filings under a law that requires the Treasury secretary to turn over returns requested by the heads&#8217; of the Congressional tax committees.\u201d<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-5.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-5.jpg?resize=270%2C187&#038;ssl=1\" alt=\"\" width=\"270\" height=\"187\" class=\"alignnone size-full wp-image-7691\" \/><\/a><\/p>\n<p>Well now. Does no one remember the \u201cAl Capone rationale\u201d? This isn\u2019t a case where tax-return confidentiality is about to be broached through some clerical error. No, the New York state Legislature has officially declared that NEW YORK STATE INCOME TAX FILINGS ARE NO LONGER CONFIDENTIAL. Therefore, requiring citizens to volunteer information about their businesses or income which might be turned over to other government agencies, which might be used &#8212; heck, which they obviously intend to use &#8212; to harm the reputation of, or even to prosecute, said taxpayers VIOLATES THE FIFTH AMENDMENT. With the \u201cCapone rationale\u201d abandoned and ostentatiously trampled in the mud, the whole damned \u201cpersonal income tax\u201d scheme is now revealed to be COMPLETELY UNCONSTITUTIONAL!<\/p>\n<p><a href=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-8.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-8.jpg?resize=300%2C157&#038;ssl=1\" alt=\"\" width=\"300\" height=\"157\" class=\"alignnone size-medium wp-image-7701\" srcset=\"https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-8.jpg?resize=300%2C157&amp;ssl=1 300w, https:\/\/i0.wp.com\/vinsuprynowicz.com\/wp-content\/uploads\/2019\/07\/download-8.jpg?w=310&amp;ssl=1 310w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>The long-suffering citizens of New York (those that haven\u2019t already wisely fled to lower-tax domiciles, of course) now need only one smart attorney and a couple of honest judges to so rule, and a century of collectivist, resdistributive, wealth- and initiative-detroying \u201cstate income tax\u201d tyranny will be at an end!<\/p>\n<p>Yay!<\/p>\n<p>But wait, it gets even better. It\u2019s not just the New York STATE Legislature.
